The impact of the collision threw the victim about 10 to 20 feet. According to news reports, the driver stopped following the collision and did not show any signs of intoxication. Cause of the San Rafael Pedestrian Accident

San Rafael police are investigating this November 30th Marin County accident. Based on the limited information provided in news reports, it sounds as though the driver of the Toyota may have failed to yield to the pedestrian in the marked crosswalk. Under California Vehicle Code Section 21950: "The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection..."

Pedestrian Accident Personal Injury Liability

If it is determined that the driver of the Toyota was driving negligently and is responsible for causing this major injury accident, the victim may be entitled to compensation for her injuries, including medical care costs and hospitalization expenses, lost earnings due to not being able to work, and pain and suffering. In situations such as this one, the family of the injured victim would be well-advised to contact a knowledgeable and experienced northern California pedestrian injury attorney as soon as possible to discuss the victim's rights in a potential claim.
